You can activate your email services only after accepting all of the terms. They are mainly designed to discourage spamming and abuse of the shared mail facilities offered by AZC, Inc. (AZC.COM). In the following, the word "you" means the customer who is attempting to use this particular service offered by AZC.COM. AZC.COM reserves the right to immediately terminate any email account(s) allocated to a customer if it deems its service policies and/or any one of the following terms and conditions have been violated. You agree: o to adhere to all terms and conditions of AZC.COM service policies. o to inform and to advise of anyone (including but not limited to yourself, your associates, and your clients) who will be using this service of the service policies of AZC.COM and the terms and conditions given herein, and to accept the responsibilities of enforcing AZC.COM's policies, terms and conditions to such parties. o that none of your email accounts will be used for sending out unsolicited commercial email (UCE), also known as spam. This includes, but is not limited to, bulk-mailing of commercial advertising, informational and/or political announcements, and other mails sent to users the customer does not have a pre-existing business or other relationship with. Such material may only be sent to those who have specifically requested it, through active "opt-in" mechanisms. Likewise, any materials promoting software or services designed to help facilitate unsolicited advertising will be construed as spam, and deemed a violation of our AUP. Malicious or threatening email is also prohibited. o that none of your email accounts will be used for mailing list purpose. o that the routine management of email boxes associated with your virtual host, including but not limited to password, and user ID assignment, is your sole responsibility, not that of AZC.COM. o to keep the disk consumption of your POP accounts within the allocated free disk space as best as you can, and in case such space limit is exceeded, agree to pay AZC.COM according to the most recently published surcharge fee schedule. o that you agree to delete your messages off the system after downloading, i.e. that 'delete mail from server' is checked in your POP client, and to the condition that all read messages will be removed by our systems after one week. o not to transfer binary or executable files directly (please encode them properly before sending them as part of an email message). o to the Electronic Communication Privacy Act of 1986 (18 U.S.C. 2701 et seq.), and that there are no facilities provided by this system for sending or receiving private or confidential electronic communications. The system administrators of this facility can read all messages left on this system, including electronic mail (email) messages addressed to persons other than the system administrators. o that if our system administrators deem it is necessary (e.g. your POP account is mail bombed by certain party), they can delete messages stored in your account. o that in no event shall AZC.COM or its employees be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this service, even if advised of the possibility of such damage.
